As far as "destroying the rights of the accused" ... when it comes to rape, I've expressed my opinions about this in Off Topic quite a bit. As a whole, the system is rigged in favor of the accused, so, ... I'm not losing sleep at night over the few who might be falsely accused. If such a high % of actual rapists get off, I'm sure the innocent guys will, too. Trust the system, right?

To answer your question. No. But, he is presumed innocent. That's the whole point of the 4th amendment. We cannot waive those rights simply b/c I think he's guilty. That's not how justice works in this country nor is it how it should work. The system is supposed to be rigged in favor the accused. It's meant to be that way to keep innocent people out of jail, and as well all know, way too many are still being put there. I understand where you're coming from. It's tricky and nasty. I'm simply asking if there's a way to cut down on some of this stuff and encourage victims to come forward without compromising the integrity of the process. People have been falsely accused and convicted of rape. That is just as bad (especially considering what happens to rapists in jail).

You also get to the core of why I don't think that matters. The physical evidence will largely prove it. He say it was consensual all he wants. The physical evidence in a case like this (if properly obtained) will say otherwise.

When I said that the system is rigged in favor of the accused, that's not quite what I meant. There are some REALLY ugly statistics when it comes to rape. Really, really ugly. It'd take me some time to dig them up, but the system is rigged and it's rigged pretty bad. I watched an eye-opening documentary a couple years back. Heart-wrenching. What did I learn? I learned that this country isn't much better about their treatment of women and children than many other countries around the world, especially regarding sexual assault. We pretend to care, but in all actuality, not so much. Women have actually been told, basically, "Yeah, I'm going to be honest ... nothing is going to come of this rape. My advice is to go home and try to move on." THOUSANDS and THOUSANDS of rape kits, ya know, from the courageous women who actually chose to come forward, go untouched for decades. DECADES. This is happening today, in our country, all over in major cities. It's gross. But we're supposed to trust the system? Nah, I'm good!

One on one, individually, it is just as bad, but the stats are so skewed in the rapists' favor that it's disgusting. So, as a whole, I'm not too concerned. Somehow, someway, it needs to be more of a level playing field in the courtroom. Some stats show that less than 1% of rapes lead to felony convictions. LESS THAN 1%?! And we wonder why women don't come forward? Why they try to move on with their lives and forget it ever happened? On the flip-side of that, nearly 90% of the victims face lasting emotional and physical consequences/distress. How is this even close to acceptable in our country? Why are the victims still facing most of the consequences? I've said it before, and I'll say it again, if ACTUAL rapists are going free at this alarming rate, I'm not going to obsess over the falsely accused. Why? Because they are going to go free, too. Less than 30% of rape victims report; somewhere between 2-8% are considered to be false reports. Now, if 995/1000 perpetrators walk free, what are the chances the falsely accused are going to be convicted? So, so, SO tiny. Not losing sleep over it. I'm just not... Not when I know what I know. There are MUCH bigger fish to fry here, and until the system isn't so effed, I'm not going to be told to trust it. But for those of you who actually believe in the system, you should be confident that the innocent guys go free, right? Trust the system; it works.

I said, I, personally, don't focus so much on that, because there are bigger fish to fry. If that makes me a bad person, so be it. But the system is VERY FLAWED -- and it is VERY FLAWED in one specific direction. Of course I'm going to care more about fixing the part that is the most messed up. That doesn't mean that I don't care about those who are falsely accused. It's pretty disgusting, actually, because it takes so much away from actual victims, ya know? Those people are disgusting and messed up. But I'm saying this: You're asking me to believe in the system; which I do not. But if you do believe in the system, do you believe that those who are truly innocent, especially in today's world with DNA and such, are going to be found innocent? If you believe in the system, everything should work itself out, right? What are you worried about then? Why are you so defensive? For every one example of the falsely accused, we could find hundreds and hundreds of people who walk free. So, exactly what are we trusting here? What exactly are you defending?

I think we agree that the system is flawed... I'm not asking you to believe the system. I don't believe in the system. I don't think anyone does.

I am, however, interested in ideas that can fix it without destroying the rights of the accused, which was what you were hinting at. I was asking for ideas.

By the way, DNA can prove that sex happened... not so much on whether it was consensual. The problem with a lot of this is the best evidence to prove it is physical evidence that needs to be obtained quickly or video. Absent those two though, it gets much harder.

A good start to fix it? Follow through with all of the rape kits that are actually turned in AND TAKE THIS CRIME SERIOUSLY. Why are hundreds of thousands of rape kits sitting around unopened? These women deserve a voice; they deserve some sort of justice/their rapists to face serious, SERIOUS consequences. They don't deserve, basically, "Too bad! Deal with it!"

I think if this crime was actually taken more seriously, we'd have more women reporting, better evidence, and then more convictions. Actual rapists? Stick it to them! ...no pun intended. For those disgusting people who false report and are proven to be liars, recant their statements, etc. -- stick it to them just the same. People need to understand that rape is UNACCEPTABLE as is lying about it.

We need to attack this from all angles if we want to clean it up. But it starts with law enforcement/health professionals. They need to do a better job collecting evidence, pursuing prosecution, and supporting the victims. And, maybe, just maybe -- if it was more of an even playing field, and rapists started getting convicted of their crimes -- just maybe they'd think twice about doing it. With less than a 1% chance of getting convicted of rape right now, what exactly is stopping these monsters? We have to do better.

All five women testified during the nine-day trial. Winslow did not take the stand.

Defense attorneys pointed out inconsistencies in the accusers' testimonies and argued the women invented the allegations to prey on the wealth of Winslow.

Prosecutors say the son of Hall of Famer Kellen Winslow felt empowered by his fame to abuse the most vulnerable.

Prosecutor Dan Owens told the jury of eight men and four women that Winslow is a "wolf in sheep's clothing."

That plea deal capped his sentence at 18 years. On Friday, a San Diego County Superior Court judge approved a change in which Winslow's sexual battery plea was replaced with a guilty plea to assaulting the hitchhiker with the intent to commit rape.

That brought the potential sentence down to 14 years. Winslow will be sentenced March 3.

His sentencing had been scheduled for last year. But it was postponed because of court closures caused by the coronavirus pandemic.
